Store Brand Baby Formula Wins a Final Round in Court

“There are no better formulas. Only more expensive ones.” That caption quoted from storebrandformula.com proved to be true when store brand infant formulas won a major victory on April 20, 2011 against Enfamil maker Mead Johnson. A U.S. Circuit Court upheld a $13.5 million false advertising claim against the latter.

The successful argument by PBM Products, Perrigo’s store brand infant formula business, was that Enfamil’s advertisements of superiority to store brand formulas were false and misleading. In fact, store brand formulas offer the same nutrients at the same levels as Enfamil. But despite having twice been restrained from disseminating misleading advertising, Mead Johnson continued to do so which made it hard and unfair for PBM to compete with Mead Johnson unless and until Mead Johnson stops infecting the marketplace with misleading advertising.

"The Court has made it clear that national brand and store brand suppliers are entitled to fairly compete and advertising abuses will not be tolerated," said Perrigo Chairman and CEO Joseph C. Papa in a statement. "We also appreciate the Court's recognition that PBM could lawfully compare its products to national brand products." For more information visit Bloomberg Businessweek .

After checking with our pediatrician, we switched from a national brand product to a store brand formula. Our pediatrician assured us there are standards to which all baby formulas need to follow in the way of nutrients and vitamins. Our 11 months old son has been drinking store brand formula since he was 4 months old. It helped us save a lot of money. And I can tell you he is as emotionally, mentally, and physically strong and healthy as any other baby drinking national brand products.

He started crawling at 6 months, and started walking at 10 months and hasn't had any illness or ear infections except for a one day fever when he was teething and a one week cough and cold last winter.

I am so thankful for store brand formulas. It helps our family and other families save on costs plus it doesn’t compromise the health and development of our baby because it has the same nutrients as national brand products. Hi! I'm a new follower from the Not So Moody Monday blog hop :)

Although I have never used infant formula for my babies (not that I wouldn't, I just have never had to since breastfeeding worked so well for us) I find that store brand products are pretty much the same as the leading brand names. We always buy store brand medicine, for example. They are so much cheaper than the leading brands but yet have the exact same ingredients and work just as well. Sometimes, especially in a large family, we just have to cut costs where we can.
